Do you sell goods over the internet or in people's homes?
As of 13th June new rules will govern how you make remote sales to consumers.
The Order Process:
- the new rules cover digital content and you will have to provide technical details up front so that the consumer can decide whether the functionality is right for them
- certain pre deal information must be provided
- confirmation emails will have to contain full details of the goods and charges
- pre ticked boxes cannot be used for extra charges such as premium delivery
- payment buttons for online sales will have to labelled in such a way that it is clear to the consumer that clicking on it will lead to a sale being completed and charge applied.
- the cooling off period is extended to 14 days
Deliveries
- Unless the customer expressly agrees otherwise delivery must be made within 30 days of order
- Services and downloads can only take place during the cooling off period if the purchaser specifically agrees and understands that they may have to pay a pro rata or lose their right to cancel
- Risk only passes on actual delivery to the customer unless the consumer arranges delivery
Post sale
- premium rate charges for certain telephone helplines are outlawed
- refunds and returns must be made within 14 days
- only standard costs of returning goods need be reimbursed
- a cancellation form must be provided
